OBJECT

The purpose of these Terms of Use is to inform the User about the use and navigation of the platform and to provide access to general information about the activities and services offered.

The website https://spstatefilmcommission.org.br/pt/ can be viewed by anyone with access to the World Wide Web, and aims to meet the needs of users by providing information, data, and descriptions about the provision of certain audiovisual-related services in the State of São Paulo;

The São Paulo State Film Commission reserves the right to make improvements to the platform’s functionalities, committing to preserving its applications as much as possible and not causing any harm or damage to users. The São Paulo State Film Commission employs its best efforts to ensure the continuous availability of its platform; however, temporary unavailability may occasionally occur due to maintenance, and the organization is committed to making every effort to stabilize the situation as quickly as possible.

PRIVACY

The São Paulo State Film Commission adopts all possible technical and administrative security measures for the protection of personal data, in accordance with applicable and current legislation and as set forth in the Privacy Policy and Cookie Policy.

Eventually, for certain personal data processing activities related to the functionality and provision of applications and services, the São Paulo State Film Commission may request your free, informed, and unequivocal consent. 

The data, whether sensitive or not, provided by users and prospective collaborators (service providers, institutions focused on audiovisual production, in general) is the sole responsibility of those who provide it. The São Paulo State Film Commission is in no way responsible for data provided by third parties, which may be made publicly available on its website .

Furthermore, when a User requests assistance from the São Paulo State Film Commission support service , some of their personal data may be requested, such as name, email, and phone number, in order to verify their identity for greater security.

The information that the São Paulo State Film Commission has access to through its website depends on the privacy settings and what the user has provided during browsing.

In case of conflict between the Terms of Use and the Privacy Policy, the terms described in the document that is more specific to the subject matter will prevail.

Neither the São Paulo State Film Commission nor its executives, associates, employees, agents, or consultants will be liable to any person for any loss, damage, cost, or expense resulting from any error, omission, or alteration in the information provided herein, nor for any delays, inaccuracies, errors, or interruptions caused by these events during the supply of any information through the website pages, nor for computer viruses or any damage resulting from unauthorized access or any other misuse of the system through which information about the website https://spstatefilmcommission.org.br/pt/ is transmitted, nor for any discontinuity of service. 

Likewise, you acknowledge and agree that the São Paulo State Film Commission will not be responsible or liable, directly or indirectly, for any damages caused or losses suffered as a result of the use of or reliance on information or materials obtained from websites, or as a result of hacker attacks, system failures, viruses, Trojans, malware, among others, that may damage users’ equipment or connection.

Considering that the São Paulo State Film Commission has no obligation to monitor the actions performed by Users when accessing its Site, it will not be held responsible, under any circumstances, for the acts perpetrated by them, including illegal acts, with the offender being solely responsible for any damages caused.

The  platform may display the logo and trademark of the São Paulo State Film Commission, which users may not use without the Commission’s prior written permission.

The other materials presented on the website, such as images, information, graphics, and others, are also protected by copyright and therefore cannot be reproduced and/or modified without the prior written consent of the São Paulo State Film Commission.

The unauthorized use of the website’s logo, trademark, or materials may result in penalties, in accordance with the legislation in force at the time. 

This platform may also contain links to other internet pages. Since the São Paulo State Film Commission has no control over third-party websites, you acknowledge and agree that the São Paulo State Film Commission is not responsible for any content or material present on third-party websites.

Providing appropriate internet access is the responsibility of the service provider contracted by the user for this purpose. In case of loss of internet connection during registration or information submission, the São Paulo State Film Commission will not be liable for any compensation , and the  user must accept the implications of any such failure. 

UPDATES TO THIS AGREEMENT

This Agreement may be updated at any time, however the São Paulo State Film Commission is committed to keeping it updated at this address. Therefore, we advise you to review this Agreement regularly, always being aware of any changes made.

LEGISLATION AND JURISDICTION

These Terms of Use shall be governed by and construed in accordance with Brazilian law, regardless of any conflict of laws with those of other states or countries, and the Court of the District of São Paulo, State of São Paulo, shall have exclusive jurisdiction to resolve any dispute or disagreement arising from these Terms of Use between the São Paulo State Film Commission and its Users. Therefore, by continuing to browse, the User accepts the jurisdiction of this court to the exclusion of any other, however privileged it may be.
